Welcome to XBT Bots (“the Site”). These terms of service (“Terms”) govern your access to and use of the Site, so please read them carefully before using the Site.

Acceptance of Terms By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.

Changes to the Terms We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Site after any changes to these Terms constitutes your acceptance of the new Terms.

Intellectual Property All content on the Site, including text, graphics, logos, icons, images, audio clips, downloads, and software, is the property of XBT Bots or its licensors and is protected by United States and international copyright laws. You may not reproduce, modify, distribute, display, or sell any of the content on the Site without the express written consent of XBT Bots.

User Content The Site allows users to upload, post, and share content (“User Content”). By submitting User Content, you grant XBT Bots a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, copy, modify, distribute, publicly display, publicly perform, and create derivative works based on your User Content.

You are solely responsible for your User Content and for any consequences thereof. You represent and warrant that you have all rights necessary to submit your User Content to the Site, and that your User Content does not infringe or violate the intellectual property rights or any other rights of any third party.

Prohibited Conduct You agree not to engage in any of the following prohibited activities:

Using the Site for any illegal purpose, or in violation of any local, state, national, or international law;
Engaging in any activity that disrupts or interferes with the Site (or the servers and networks connected to the Site);
Impersonating another person or entity, or falsely representing your affiliation with a person or entity;
Attempting to gain unauthorized access to any portion of the Site or any system or network connected to the Site;
Posting, transmitting, or otherwise distributing content that is unlawful, defamatory, obscene, pornographic, indecent, harassing, threatening, or otherwise objectionable, as determined by XBT Bots in its sole discretion;
Posting, transmitting, or otherwise distributing content that contains viruses, malware, or other harmful code;
Engaging in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site.

Termination XBT Bots may terminate your access to the Site at any time, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account.

Disclaimer of Warranties The Site is provided on an “as-is” and “as available” basis, without any warranties of any kind. XBT Bots expressly disclaims all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability In no event shall XBT Bots be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or these Terms.

Indemnification You agree to indemnify and hold XBT Bots harmless from any and all claims, damages, expenses, and liabilities (including attorneys’ fees) arising from or related to your use of the Site, your User Content, or your violation of these Terms.

Governing Law These Terms shall be governed by and construed in accordance with the laws of the United States and the State of [State], without giving effect to any choice of law or conflict of law provisions.

Dispute Resolution Any disputes arising out of or related to these Terms or the use of the Site shall be resolved through binding arbitration, rather than in court. Entire Agreement These Terms constitute the entire agreement between you and XBT Bots regarding your use of the Site, and supersede all prior agreements and understandings, whether written or oral.

Waiver and Severability The failure of XBT Bots to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
